1. Acceptance of Terms

By participating in the Wheel Spin (“the Wheel Spin”) on JonSandman’s Twitch channel (“the Channel”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (ToS). If you do not agree to these terms, you must not participate.

2. Eligibility

1. Age Requirement: Participants must be at least 13 years of age, in compliance with Twitch’s minimum age requirement. If you are under 18 years of age (or the age of majority in your jurisdiction), you must have the permission of your parent or legal guardian to participate.
2. Jurisdictional Restrictions: This Wheel Spin is void where prohibited by law. It is your responsibility to ensure that participation in this activity is permissible under the laws of your jurisdiction.

3. Nature of the Activity

1. Entertainment Purpose Only: This Wheel Spin is conducted solely for entertainment purposes and does not constitute gambling, a lottery, or any form of real-money wagering.
2. No Monetary Value: The outcomes of the Wheel Spin and any associated alerts or virtual rewards carry no real-world monetary value.

4. Not Affiliated with Third Parties

This Wheel Spin is not in any way sponsored, endorsed, or administered by, or associated with, Twitch, Amazon, or any other third party. All information you provide is given to JonSandman and his team, not to Twitch or any other platform.

5. Entry Methods

Participants can enter the Wheel Spin only when the Channel is live via one of the following methods:

• Monetary Entry
  • $3.00 (USD) payment (e.g., a tip/donation)
  • 300 Bits
  • 10 Gifted Subscriptions (value $60.00 USD) – provides 10 entries at once
• Non-Monetary Entry
  • 30,000 Channel Points
• Free Entry
  • By being the 1st, 50th, 100th, 150th, 200th, 250th, 300th, 350th, or 400th viewer to check in for the day using the designated Channel Point redeem (costs 10 Channel Points, which are refunded upon redemption).

Each paid or free redemption is considered one (1) spin. There is no limit to how many times a participant may enter or spin while the stream is live, provided they meet the entry requirements each time.

6. Wheel Spin Outcomes

When a participant enters, a wheel spin animation plays on the Channel. The outcomes and associated probabilities are as follows:

• Blues (7 outcomes): 79.92% chance
• Purples (5 outcomes): 15.98% chance
• Pinks (3 outcomes): 3.2% chance
• Reds (2 outcomes): 0.64% chance
• Gold (Jackpot, 1 outcome): 0.26% chance

These outcomes correspond to on-screen alerts for viewer entertainment. No outcome grants any monetary or cash equivalent prize.

7. Jackpot Prize

1. Discord Rank: If a participant lands on the Gold (Jackpot) outcome, they receive a special rank on JonSandman’s official Discord server: https://discord.gg/R4CPF77wMU.
2. Access to Exclusive Channel: Holders of this special rank gain access to a members-only Discord channel where they can interact with JonSandman and his moderation team.
3. No Real-World Value: The special rank and channel access:
   • Have no monetary value and cannot be sold, traded, or transferred.
   • Are valid only on the official Discord server and remain subject to the server’s rules.

8. Data Collection & Privacy

1. Data Collected: For the purpose of administering the Wheel Spin, JonSandman and his team collect the following information:
   • Your Twitch username or display name.
   • Whether you entered via free or paid methods.
   • The outcome of your spin (e.g., Blue, Purple, Pink, Red, Gold).
2. Use of Data: This information is used solely for:
   • Verifying entries.
   • Identifying winners of the Jackpot outcome.
   • Displaying usernames on-screen during the live spin.
3. No Sale of Personal Data: JonSandman and his team do not sell or otherwise transfer personal data to third parties, except as required by law or to fulfill legal obligations.

9. Live Stream Participation

1. Live Only: The Wheel Spin is available only while JonSandman’s Twitch stream is live. Any attempts to enter or spin while the stream is offline are invalid.
2. Final Results: Once a spin is completed, the result is final. No re-spins or disputes will be entertained unless a technical error (e.g., software malfunction) is clearly demonstrated.

10. Limitation of Liability

1. Technical Issues: JonSandman and his team are not responsible for any technical failures, such as internet connectivity problems or platform downtime, that may prevent or hinder your participation.
2. Assumption of Risk: By participating, you acknowledge and assume all risks associated with chance-based activities and the operation of third-party platforms (e.g., Twitch).
3. No Guarantee of Outcome: Participants accept that there is no guarantee of winning any particular outcome, including the Gold (Jackpot).

11. Void Where Prohibited

Participants are solely responsible for ensuring that participation in the Wheel Spin does not violate any laws or regulations in their jurisdiction. If such participation is prohibited, you must refrain from entering.

12. Changes to the Terms of Service

JonSandman reserves the right to modify or update these ToS at any time. Notice of any changes will be provided via:

• Announcements on the Channel, or
• A message posted in the official Discord server (https://discord.gg/R4CPF77wMU).

Continued participation after changes have been made constitutes acceptance of the revised ToS.

13. Governing Law

These Terms of Service are governed by, and construed in accordance with, the laws of the State of California, USA. Any disputes arising from these ToS shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.

14. Severability

If any provision of these ToS is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
